HOW LONG WILL THE PROCESS TAKE IN YORK?

The timeline for completing a conveyancing process in York depends on various factors.

Typically, buying or selling a home takes 8 to 12 weeks. This timeframe assumes there are no complications involved, such as a chain or, the seller requiring a grant of probate before selling.

WHAT IS THE PROCESS TO BUY A PROPERTY IN YORK?

  1. We request the ‘Contract Pack,’ from the Seller’s solicitor. This includes essential documentation related to the Title of the Property, such as title deeds. We will also need a copy of your Mortgage offer.
  2. We conduct Searches against your Property to identify any potential adverse risks. This is an important part of the process to highlight any problems you should know about before purchasing.
  3. We also raise Enquiries with the Seller’s solicitor in relation to any issues identified within the documentation obtained.
  4. After reviewing the search results and responses to any enquiries, we provide you with a formal Report on Title. This covers all important issues relating to your purchase which you must consider before progressing.
  5. If you are happy to proceed, we will arrange a date to exchange contracts with the sellers’ solicitors. Once you exchange the contracts, the sale becomes legally binding.
  6. We transfer the deposit funds to the Seller or more commonly, hold them ‘on account’ until Completion. We liaise with the Seller’s solicitors to agree a date for completion. Sometimes this may be the same date as Exchange of Contracts.
  7. The final stage is Completion. We request the necessary funds from your Lender and provide you a detailed Completion Statement. The Completion Statement specifies the exact amount required to complete the transaction.
  8. On Completion, the Seller must have vacated the Property if not already done. We transfer the purchase price funds to the Seller’s solicitor.
  9. You can get the keys to your new home from the Estate Agent after we confirm the transaction is complete.
  10. We handle payment of any Stamp Duty Land Tax and register the Property in your name with the Land Registry. We have now completed the transaction.

WHAT SEARCHES MAY APPLY TO MY PURCHASE IN YORK?

  • Local Authority Searches are important for finding any restrictions or charges that could affect future development on your Property.
  • Water and Drainage Searches: Provide information on mains waterworks and drainage.
  • Environmental Searches: Detail any important environmental issues that could affect the Property.

Our process for selling your home in York involves the following stages:

1- We obtain updated Title documentation from the Land Registry.

2- We then prepare the Contract for sale and send it to the Buyer’s solicitor. If there are any mortgages against your Property, we obtain redemption figures from the mortgage company.

3- The Buyer’s solicitors draft the Transfer Deed for your approval. After completion, we send this document to the Land Registry for the transfer of ownership.

4- Once the Buyer’s solicitors review the draft Contract, we will respond to any enquiries, negotiate a date for exchange and completion, and request a Redemption Statement from your existing Lender.

5- On completion, we receive the purchase monies from the Buyer’s solicitor, inform you of completion, and authorize your estate agent to release the keys to the Buyers. We redeem your mortgage, settle the estate agent’s fees, and transfer the remaining sale proceeds to you, concluding your sale transaction.
