HOW LONG WILL MY PROPERTY TRANSACTION TAKE IN MAIDSTONE?
The time between you purchasing or selling your home and moving house is reliant on a range of factors. On average, we would estimate that the conveyancing process may take from 6 to 12 weeks.
Transaction times can vary, and depending on the situation may be shorter or longer than estimated.
Before selling, some properties require a legal document known as a Grant of Probate. If you’re a first-time buyer purchasing a new property, the property may not have been built yet. All such elements outside our control can impact upon the overall length of time taken to complete your transaction.
WHAT IS THE PROCESS OF PURCHASING PROPERTY IN MAIDSTONE?
The first steps in buying a house in Maidstone involve us asking the seller’s solicitors for the Contract Pack. Contract Packs include copies of the Land Registry Title, or Title Deeds.
If you are not a cash buyer and require a Mortgage, we will need a copy of your mortgage offer. Your Lender can also send this to us directly.
Carrying out Searches is the most important part of the purchase. This is necessary to determine whether the Property has any issues you must consider before purchasing.
We will need to consider the search results, review your Mortgage offer and the Contract Pack. Once we have done this, we raise any enquiries with the Seller’s solicitor.
Once we receive a response to our enquiries, we will prepare the Report on Title. This formally sets out any important issues that you need to review.
Provided you are happy to go ahead, we negotiate a date for Exchange of Contracts.
Before Exchange of Contracts, we will request funds from your Lender and prepare a Completion Statement. This Statement tells you exactly how much we need to complete the purchase.
We and the Seller’s representatives mutually agree on a specific date and time for exchanging contracts.
At this point that the transaction becomes a legally binding contract upon you and the Seller.
We are now in the final stage of the transaction, known as Completion.
We set an agreed time and date for Completion to take place. Sometimes the completion date is on the same day as Exchanging contracts.
The Seller will leave the Property and we will ask your Mortgage company for funds if they haven’t already sent these.
The Buyer sends the funds for the property purchase price to the Seller’s solicitor on the agreed day of completion. After that, you can obtain the keys from the estate agent.
Following completion, we will pay Stamp Duty Land Tax and proceed to transfer ownership in your name with the Land Registry.
WHAT SEARCHES WILL I REQUIRE IF I AM PURCHASING PROPERTY IN MAIDSTONE?
Most searches are general but your conveyancing solicitor also may request searches specific to the local area in Maidstone.
Maidstone falls by the River Medway. Depending on where the Property you intend to purchase is in Maidstone, we would recommend a Flood Risk search. Large quarries exist around the local area, and there are at least 3 such locations in Maidstone. We should conduct mining searches to determine if a former mine could affect the Property.
Other typical searches encompass:
– Local Authority Searches, the most crucial searches. They determine whether there are any legally binding restrictions or planning decisions that could impact the Property
– Environmental Searches: Water and drainage Searches provide essential information concerning mains waterworks and drainage.
– Property Searches to determine whether there are environmental issues that could affect the Property
– Land Registry Searches to ensure the Property is legally safe to buy
We may need to do more searches depending on the property you’re buying, and if your Lender requires these.
