HOW LONG WILL THE CONVEYANCING PROCESS TAKE IN LANCASTER ?

How long the conveyancing transaction will take to complete is dependent on a variety of factors.

On average, buying or selling can take from 8 to 12 weeks for a straightforward freehold transaction (i.e. no chain / cash purchase)

It may take place sooner or later than this estimate, as the circumstances of your transaction compared to another will vary considerably.

WHAT IS THE PROCESS BUY A HOME IN LANCASTER?

The first stage of the process is to ask the seller’s solicitors for the Contract Pack. Within this are important documentation in relation to the Title of the Property, such as Title deeds. We will also need your mortgage offer if you are not a cash buyer.

An extremely important part of the process is to conduct Searches against your Property. We must do this to identify whether your proposed purchase faces any adverse risk.

Once we have considered the search results and received a response to any enquiries raised to the Seller’s solicitor, we will a formal Report on Title. This shall detail all important matters you need to consider. 

If you are happy to proceed with the transaction, we prepare for exchange of Contracts.

Once we have exchanged Contracts, the transaction is legally binding. We will either transfer the deposit funds to the Seller or hold these ‘on account.’

The final stage is Completion.

Occasionally, we may complete on the same day as exchange of contracts.

If you have a mortgage offer, we will request all funds from your Lender.

We will prepare a Completion Statement. This will detail exactly how much we need from you to complete the purchase. We will require all funds prior to exchange of Contracts.

Completion will take place on a date agreed with the Seller’s solicitors. The Seller will vacate the property if they have not already done so. They receive full payment on the day of completion.

After the Seller’s Solicitors receive the funds, you can get the keys to your new home from the estate agent. The transaction is now complete.

Following completion, we will pay Stamp Duty Land Tax and register the Property in your name with the Land Registry.

WHAT SEARCHES MAY APPLY TO MY PROPERTY PURCHASE IN LANCASTER?

–       Local Authority Searches. These determine whether the Property is subject to any binding restrictions or local charges.

–       Water and drainage Searches to ensure you are aware of the essential information concerning mains waterworks and drainage.

–       Environmental Searches will note any environmental issues that could affect the Property

–      Land Registry Searches shows any Title changes and are important as they protect your Lender’s interest in the property.

–       Flood Risk Searches should be carried out if there are concerns that the Property is vulnerable to flooding. This is important in Lancaster, given the proximity of River Lune and the risk of flooding.

If you need a mortgage, your Lender will require at the very least: a Local Authority, Drainage and Water and Environmental Searches. We may need to conduct some extra searches which we will inform you of, if necessary.

We will require the following documentation:

–       photographic identification

–       proof of address

–       proof of funds for the purchase

–       Your mortgage offer

Firstly, we need the Title documentation to the property from the Land Registry.

We begin to prepare the Contract for sale and request any other documentation necessary.

If there are any mortgages, we will need redemption figures from the mortgage company.

The Buyer’s Solicitors provide us with a copy of Transfer Deed for approval. After completion, the Land Registry will be sent this to transfer property ownership to the Buyer.

Once the Buyer’s Solicitors have reviewed the draft Contract for sale. They will likely raise any enquiries at this stage.

Once we have responded to these enquiries, we negotiate a completion date. Then we begin to prepare for exchange of Contracts.

We request a Redemption Statement from your existing Lender. We will also obtain details of the local estate agent’s fees and prepare a completion statement.

On completion, the Seller’s Solicitors will send the purchase monies to us. We will inform you that completion has taken place and authorise your estate agent to release the keys to the Buyers.

Once we receive the monies, we redeem the mortgage. We will also settle the estate agent’s fees and transfer the remainder of the sale proceeds to you. This concludes the transaction.
